Monstrous! MP Nandala Mafabi accused of exhuming Voter’s Dead Wife with Intent to Grab Property

MBALE, Uganda: Former Leader of opposition in Parliament and Budadiri west constituency MP and Secretary General of FDC, the Country’s main opposition party Nathan Nandala Mafabi has been exposed as a heartless leader with among others, no respect for the dead.

The legislator has been accused of having ‘stolen’ one of his electorates’ wife’s remains and illegally transferring the same after reportedly forging land documents in a bid to illegally take possession of his accuser’s property. He is accused of forgery of transfer forms before his subsequent possession of the Mbale-based property through back door, with help of the already troubled Lands Commissioner Sarah Kulata!

Stephen Wobweni, a Ugandan businessman based in Pretoria, South Africa is the man being haunted by the lawmaker. He accuses Nandala of forcefully grabbing his land using forged documents. He (Mafabi) reportedly forged Wobweni’s signatures on transfer forms and a driving permit to convince Uganda Land commission that the seller (Wobweni) was untraceable but had left the particulars behind.

“A transfer was lodged in this office over the above land in favor of Hon. Nathan Nandala Mafabi. I note that the signatures of the vendor differed in material particulars and I requested that he appears for identification and verification of signatures. The Hon. has now sworn an affidavit to which he intimates that the vendor can’t be availed as he is in South Africa,” read an internal memo.

Authored and presented by Haruna Golooba, the Registry Secretary, the internal memo suggests that Nandala be availed the property. It’s said, Nandala with assistance of top land bosses managed to use the forged transfer forms and driving permit to effect the transfer.

Also forged is a minute in which they claim they summoned the purported ‘seller’ in vain, hence taking the decision to transfer the titles to the piece of developed land premised at plot 4, Nakaloke Road, volume 391, FRV 29/5, Folio 21 in Mbale Municipality, about 500 meters away from IUIU.

The Genesis

In December 2011, Wobweni’s businesses both in South Africa and Uganda faced some financial setbacks and needed a financial boost. He approached his Budadiri –West area MP, the Hon. Nathan Nandala Mafabi for UGX150M to which he obliged.

However, Nandala, like most ‘smart’ moneylenders in Kampala, insisted that for him to lend Wobweni any monies, he had to deposit with him, the land title with a ‘sale’ agreement. The Honorable member’s lawyers of Ms. Mutembuli & Co. Advocate provided the ‘sale agreement’ as security/assurance that he would repay the money. Both parties recognize that it was not a sale deal but security for the money under the gentle man’s understanding.

According to Wobweni, he accepted the conditions because he knew Nandala as a leader in his community with very high moral standards and integrity with no doubtable tricks. “But apart from the integrity part, I was also comfortable because I retained the transfer forms, resting assured it was not a sale. I knew no one could change ownership without signed transfer forms by the rightful owner.”

He argues that even if Nandala had decided to shade off his integrity, he should desist from concentrating on amassing wealth through dubious means. “So, after that transaction of UGX.150M which came in three installments, I indeed went back to South Africa around March 2013 to re-capitalize and boost my business until around June 2016, but I kept in close communication with Nandala.”

However for some few months communication slowly begun to break down as Nandala would sometimes not pick Wobweni’s calls nor respond positively to the emails, “I started getting worried, that’s when I started getting suspicious and decided to return in June 2016.”

Wobweni’s utter shock and surprise was when he went at his property and found that the grave of his dear wife had been dug, her remains exhumed and taken! He was told that it’s Hon. Nandala Mafabi who ordered for the exhumation. More annoyingly, Wobweni learnt that the remains of his best half were taken back to his father in-law from where he had officially married her!

He was to get more paralyzed. Upon reaching the lands offices to check on the status of his land, like he anticipated, he found that an attempt was being made to use forged transfer forms and driving perming to change ownership of the now disputed land into Nandala’s names. “I have never possessed a driving permit but these people purportedly presented an ‘International permit’ in my names and photo at lands that I had left it with them to make the transfer!”

Nandala’s take

In an affidavit sworn by bullet hardened opposition honcho seen by the Investigator, Nandala maintains the UGX.150M was for buying the disputed land and not borrowing as Wobweni avers. He backs his oath with the ‘sales’ Agreement and possession of original land tittles, though without transfer forms duly signed by the seller as per the law.

“I Nathan Nandala of P.O Box 8995, Kampala take oath and solemnly declared that I’m an adult Ugandan Citizen of sound mind and with capacity to make this statutory declaration the contents of which are with in my knowledge. I further confirm the purchase of Plot 4, Nakaloke Road, Folio 21, Volume 391, Mbale District from Steven Wobweni as a vendor on 28th/ 12/2011 at UGX 150m.”

Nandala, in his affidavit rubbishes claims that the UGX 150m given to Steven Wobweni was a loan supposed to be paid back but rather a payment for purchase of the property. “I have never been a money lender in my life, I finished his payment on 15/2/2012 in exchange for the above land mentioned and he signed the transfer forms” Nandala’s affidavit reads in part.

However, Wobweni maintains Nandala forged the transfer forms and driving permit to defraud him. He also alleges that the Uganda Land commission officials connived with him (Nandala) to fake minutes that they wrote to him through his lawyer for a meeting to resolve the matter but he purportedly failed to comply, they went ahead and convened a meeting which was only attended by one party (Nandala) where they passed a resolution to lift the caveat and then changed ownership in just three days.

“Whereas you were effectively served with the invitation for the meeting neither you nor your advocate appeared for the meeting. Nonetheless the meeting proceeded in your absence and a decision was taken. In light of the above, the caveat lodged by you is accordingly rejected and returned to you. You are also informed that the transfer to Nandala Mafabi is accordingly entertained” responded Commissioner Land Registry Sarah Kulata Basangwa on 28/8/206 to Wobweni.

However, Wobweni thinks different about Sarah Kulata’s action; “Even before they went ahead with their illegal activity, one of their very own Haruna Golooba had written an internal memo [copy of which I have] indicating that the signatures produced by Nandala purported to have been signed by me were not corresponding and he advised that I be summoned.”

They never summoned him but simply minuted that they had summoned him through his lawyers whereas not. “My lawyer’s chambers are just next to their office, she has never received any communication in that regard, they wanted to justify their heinous acts” Wobweni fumed… Watch this space…
