The same move had been set in motion by the Inspector General of Government (IGG), a week ago, The Investigator reports.

In her letter dated April 28th 2025, the IGG, Betty Olive Namisango Kamya Turomwe aka Ms. IGG BONKT, had instructed the Lands, Housing and Urban Development Permanent Secretary (PS), Mrs. Dorkas W. Okalany, to effect Mugaino`s interdiction orders in seven working days. This stance, supposedly to facilitate the investigations into the alleged fraudulent transfer and cancellation of land titles, among other accusations.

Her instructions, BONKT said, stemmed from a search and seizure operation at Mugaino’s office on April 24th2025, “during which key documents were confiscated.” She further accused Mugaino of supposedly authorizing the replacement of authentic certificates of titles with fake special ones, lifting caveats arbitrarily, creating overlapping titles, and issuing freehold titles to foreigners, actions she said, violate legal procedures and court decisions!

However, at court yesterday, the matter, which was deposited by Mugaino upon Kamya`s directive, came for mention before Hon. Justice Acellam Collins, in the presence of Counsel Bazira Anthony, for Mugaino, Counsel Kadoli Wanyama, the Assistant Commissioner for Civil Litigation, appearing jointly with Counsel Ochom Kiwanuka, the State Attorney and for the 1st Respondent (Attorney General), and, Counsel Mary Mugala, stepping in as counsel for the 2nd Respondent – the IGG.

“It is hereby ordered as follows; 1. An administrative order issue restraining and preventing the implementation of the directive by the 2nd Respondent and by the 1st Respondent in their letter dated 28th April 2025 and 23rd April 2025 by the 1st and 2nd Respondents, their agents or by anyone acting on their authority or from further implementation of the impugned decision of the 2nd Respondent, until the hearing and determination of the main application pending before this Court. Given under my hand and seal of this. Honorable Court this 5thday of May 2025,” read Justice Collins` order.

The Order

Citing constitutional and statutory provisions that empower her office to demand her action, Kamya had given the much-willing Okalany only seven working days to proceed and confirm Mugaino’s exclusion from office! Why Okalany was, and still “much-willing” is a story for another day. Going forward, Ms. BONKT`s action attracted public criticism, especially putting in consideration, that whatever she placed as charges against the person of Mugaino were actually committed long before his appointment to the office.

“Cut the crap and tell the truth that you`re under the influence by Mugaino`s adversaries,” thundered one of the commenters who offered to engage in the discussion of the issue touching the Commissioner`s purported interdiction on IGG`s X handle. Many knowledgeable contributors cited Mugaino`s brave move where, he had earlier recalled land titles belonging to moneybags NSSF, citing fraudulent acquisition of the same – details of this matter is before our investigations desk for another day.

Again, those in `Mugaino`s support` cited another move by the commissioner, to introduce Blockchain, a worldwide approved, more transparent system, at the ministry. For starters, the Decentralized Land Management System is the blockchain-based solution, designed to address the challenges in traditional land management.

Blockchain provides a secure, transparent, and decentralized platform to manage land records efficiently, mitigating issues such as fraud, lack of transparency, and inefficiencies. Interestingly, this system is the latest acquisition Mugaino was laboring to introduce, with a view of fighting the same tribe of fraud Kamya and her agents are instead accusing him of reportedly committing!

It is public knowledge in Uganda, that any attempt to cub corruption at the Lands Ministry, is a direct attack on the moneyed land-grabbing mafioso and their fraud networks, unfortunately comprised of the very ministry`s bigwigs, top politicians and influential elements at the Public Service docket among others.

At The Investigator, we are persuaded that even with Mugaino`s interdiction successful lifted, the seemingly anti-graft advocate at this sensitive docket is faced with even a harder challenge ahead. This stance, unless protected by the appointing authority, who`s intentions to place him there, we understand, was to do what he is being blocked from performing – fighting corruption in-there. Again, this can only be the case, just if the center holds anymore! Watch this space…

He went an extra mile to even offering them an alternative. But alas! The mafia in this deal seem determined to bend any laws and or advice, irrespective of where it comes from. All this, in the name of having the purchase dimes land nowhere but in their pockets.

On this website lies a story where, the president, Yoweri Kaguta Museveni, on top of his advice, had instituted a parallel investigations team alongside that of Inspector General of Government (IGG), to get to know the in-depth detail why many parties and individuals, including one in his homestead, are madly interested in a particular,yet questioned property, for Electoral Commission to buy a permanent home.

The son of Kaguta`s instincts were not a mere illusion. Preliminary investigations have it that all parties deeply involved in the matter are doing so in favor of the Butabika land comprised in plot 9, Dukes Road in Kampala. The land is currently occupied by structures of former GEMS Cambridge International School, the same owned by a Kampala businessman Pradip Karia. 

The revelations are that so much incentives have already exchanged hands to the extent of compromising almost all the stakeholders in the transaction. It could be the reason why, even the IGG has since changed her mind and religiously cleared the piece of land previously declared by NEMA as a wetland preserve, only fit for “construction of wastewater treatment facilities, eco-tourism and other leisure related activities, on a maximum area of 30 acres.”

But as the IGG changes positions, we can irrefutably divulge how a new owner has emerged for the very land that EC is being pressurized to purchase! We are not bluffing. His name is Isma Zuma Kisseka Mawanda. The new owner in the mix, has gone ahead and placed a caveat on the land. He took the action, to stop the people marketing it for sale. The new development will ideally complicate these already complex matters for the people strenuously talking to EC to purchase it. Such people, needless to mention again, include the big man in the president’s compound. 

Mawanda has escalated these matters further by taking it up with the Internal Security Organization (ISO). Bearing the subject; “Procurement Process of Acquiring of the New Offices of Uganda Electoral Commission in Butabika”, the complaint is addressed to the ISO boss, Charles Oluka.

Mawanda claims to have inherited the land from his departed grandfather, Kisekka Musajjatadiba. He explains that while he was away in Zambia for two decades, Pradip Karia, working in concert with KCCA, altered the land to Property Services Limited, a real estate firm. Pradip owns this company. He has since constructed a school on the now contested land, which he has since, also abandoned and he is now talking to EC to purchase the same.

Before we forget, this land has also ever been registered by whoever registered it, in the names of Nationwide Properties Limited. For the reason that the land is a wetland, the firm went ahead and obtained a permit from NEMA before using it. This, by lying to NEMA that they were not going to use it for any other purpose, apart from that of constructing a waste management plant and for recreation services. Yet, the firm ended up blowing its cover by constructing the other international school mention earlier! 

Even then, and as it turns out, the ownership of the land is currently in the names of Pradip Karia, Minex Nandilal Karia, Kinnal Pradip Karia, Alnasir Gulamhussein and Nadir Hassan Virani. Each one of them, is listed to own an equal share in the land. For purposes of clarity, each of them own 20 percent of the land!  This fact is clearly borne out by the Title of the land in question. And yet, no one can tell, except himself, why Pradip used Property Services Limited, to bid for the EC deal! This posture, in the face of the glaring reality that the firm is a stranger to the deal, at least, going by the title of the Title itself.

As we are still at it, the IGG, Betty Kamya Namisango Turwomwe has also mixed up these matters a lot more! Whilst her own officers visited the land in the past, and confirmed it to be a wetland, she has since changed positions. She now asserts how the land is so suitable. And so, she strongly backs EC to hurry up and purchase it! She sweetens up her submissions by informing the president how EC has spent eight years now, looking for the land for its home, but in vain. This stance, as if EC must recklessly purchase any land that is thrown at it, merely because it has taken time to find the same!

She wrote to the president as currently as 29th April 2022, changing the goal postsin less than a month! The president himself had written earlier before, counseling EC and whoever was marketing the land, to leave it alone, because it is a very, very strategic wetland. Yet the IGG is here now, asking his boss to depart from his executive advice and take on her’s. And which hers, looks to be masked in controversy! We hold so, because the IGG herself had written earlier before, to advise that the place EC is being asked to purchase, is a wetland!

As we try to figure out what is going on, we again get to hear of reports that the government Chief Valuer, who had earlier valued the land at UGX111Bn, has since scaled down the price to UGX75Bn! One pondering over all these issues, gets away with the impression that what is happening is happening because whoever is selling this land wants to hurriedly get it off their hands, remembering that it’s a wetland where they went ahead and built a school against what they had agreed with NEMA. We shall leave it at that for now but pledge to possibly carry out a background check on the people owning this land because we respectfully feel something is wrong.

She ended up in the dock after having purportedly barred graft investigators attached to the IGG from accessing her office. The detectives had paid the visit to retrieve what they claim was evidence linking Byenkya to corruption. 

We hope you might be knowing that story by now. Betty Olive Namisango Kamya Turomwe, the IGG, filed these charges against Byenkya. This is how the powerful woman at ULC ended up arraigned before the Kololo-based anti-graft court.

The presently out-on-bail Byenkya faces the music with three cops offering guard duties at her office who she is assumed to have instructed to keep at bay Kamya’s agents. That was but the preamble. 

We now beg to present as well as discuss another interesting angle to this story which the media had by now conceivably overlooked. We are going to do this by posing the question: Did Kamya use a flawed process to pursue a just cause? We shall answer the question in affirmative and then give our reasons for holding so. Here we go.

First and foremost, and with candid respect, we are of the considered view that the good IGG erred in turning up at the office of Byenkya in the style and fashion she chose to. 

We hold so because we feel the agents of the IGG required to obtain a search warrant (SW) from the courts of law prior to turning up at the offices of Byenkya let alone going in to search for whatever they wanted to retrieve. 

That is the lawful and ideal procedure under the legal and ideal environment to follow in pursuing matters the IGG was pursuing. We feel and now courteously submit that since the agents of Madam Kamya had turned up at ULC minus a SW from a competent court of law prior to doing so, Madam Byenkya was justified in turning them away. 

Not only were the visitors unsanctioned, but were also unwanted. One would even describe them as gate-crashers or trespassers if he or she were to choose so. 

We contend that ULC which is naturally one of the sensitive offices in the motherland by the fact that therein is stored highly valuable documents, cannot be accessed and searched at one’s whim. 

This is why we strongly think one seeking to gain access to sensitive info at ULC would need to seek for court permission or at least have the courtesy of informing the people in charge prior to doing so other than storming the place in a Ki-nigeria-like fashion as if they were walking into an abandoned dwelling in an equally deserted land.

One acting as the agents of Kamya chose to in this matter would run the risk of being treated as playing to the gallery (read attention seekers) no matter what he or she could be pursuing a justifiable cause in the first place.

A case can be made that the investigators had identified themselves to the people at ULC as agents of the IGG and what had taken them to the offices. Well, Uganda is gifted with biological characters who have and continue to impersonate people they are factually not including falsely posing as special aides complete with documentation of the First Son himself!

That said and done, a person in the shoes Byenkya is in is naturally and legally bound to take great care as not to welcome as well as offer entry to any stranger simply because he or she happens to turn up at her offices claiming to be working for this and that office. 

Yes Kamya is the IGG. She is also obliged to fight graft. But that doesn’t give her the leverage to do as she wishes or to be highhanded. She must act according to the laws of the land lest her cases would end up being tossed on the ground of having persecuted instead of prosecuting the suspects.

Immediately after Kamya initiated her prosecution, Byenkya claimed how she was using her current office to persecute her over a past scandal which purportedly saw the then minister for Lands falsely soliciting for a supplementary budget from the National Assembly in the name of ULC.  

Byenkya says because she denied having generated the issue of the supplementary budget as the minister was telling the National Assembly, Kamya felt embattled and saw her appointment as the IGG as a perfect opportunity to take revenge against Byenkya.

Well, those matters Byenkya raised came up in the past and the National Assembly actually rejected to appropriate the funds in billions, which Kamya reportedly had told the lawmakers ULC required.

While we don’t buy into Byenkya’s argument above wholesome, we nevertheless think it adds a spin to the beef between her and Kamya. 

It would certainly excite the court trial should Byenkya’s attorneys choose to pursue that line of defense. We shall really love to hear Kamya’s rejoinder to the scandal which has, since it broke out, never fully put to bed.
