According to Edith Nagujja’s lawyers, the caveat is still intact to-date yet KCCA continues to insist it bought a clean Title. But basing on the fresh evidence, the old woman contends what Jakana sold to KCCA was nothing but hot air. The case has now sucked in the commissioner of land registration.

The widow wants the commissioner to be summoned to explain to court how he was able to issue a Title to KCCA, at the time when her caveat was still present on her mother Title. She rejects KCCA’s and Jakana’s assertions that she was served through her postal office box number, asking her to go to the commissioner of land registration’s office to show cause why the caveat she had placed on the land shouldn’t be removed.

She wonders how, if her caveat was removed from her mother Title, as it is claimed, it is still again present there. Following the fresh revelations by the widow, the deputy registrar of the High Court’s Land Division, Agnes Alumu, has set June 1st this year for her lawyers to formally apply for the commissioner’s appearance. She wants the commissioner to produce the White page of the Title to show whether her caveat is still there.

And if it is no longer there, she wants the commissioner to explain under what circumstances it was removed and while it’s still present on her own copy. Nagujja, in civil Suit No. 1090/19 of the High Court of Uganda at Kampala, Land Division, is seeking legal redress over 0.066 acres comprised in LRV 4552 FOLIO 13 BLOCK 203 PLOT 11780 Land at Kazo, Kyaddondo, that was allegedly sold to Kampala Capital City Authority (KCCA) by her son Daniel Jakana and his company of Jakana Foods Ltd, in disregard of an existing caveat.

Nagujja holds an equitable interest claim that the current proprietor, Jakana Foods LTD owned by Daniel Jakana, having been registered thereon without her consent as a kibanja holder, was subject to Civil Suit No. 1099 of 2019 which seeks for cancellation of the impugned Certificate of Title which was duly registered.

In the face of the said Plaintiff’s caveat, KCCA transacted with Jakana Foods LTD, leading to the mutation of 0.066 acres off the described land for purposes of construction of a drainage channel yet the caveat was at the time still intact.

The unique function which is a rare abominable occurrence in the Buganda cultural norms, was held at their family home in Kawempe, Kazo in Angola zone after his fellow family members led by the 93-year-old mother Edith Nagujja Jakana, and her surviving children who include; Beatrice Nampiima, Rosemary, Betty Nakkungu and Steven Kagiri Jakana, all called for the much-needed dethronement.

This follows a petition to the clan leaders by Nagujja and her other children which was delivered on January 4th2023, in which they accused the heir Daniel Lule Jakana of, among others; (1) Dubious sale of family estate land without notification of other family members; (2) Disrespect of his elderly mother by constructing a septic tank in her compound adjacent to her living room, in disregard of her failing health; (3) Adamant refusal to allocate property estate to his siblings as his father`s Will dictated and; (4) Failure to appear before the Clan leaders.

New Heir: Steven Kagiri

Thus, the Clan heads in a letter dated 30th January 2023 and signed by the Salongo Kalemba Musisi Eria, the Clan Katikkiro, annulled Dan Lule Jakana’s reign as the heir of his late father. After a series of family meetings in consultation with the clan leaders, it was amicably resolved that his younger brother Steven Kagiri Jakana takes over the mantle. It is in this respect that the occasion of installing the new heir Steven Kagiri Jakana was held.

Present at the unique function were clan leaders led by the Secretary, Edward Muganda Akeera, and members Ssenkubuge Francis, Kasobya James, Mpiima Charles, and Ssekalala Richard among others. Though invited for the ceremony, Daniel Lule Jakana did not attend.

It should be noted that Daniel Jakana allegedly approached the Buganda Land Board for the lease of their Kawempe family home land and parceled out the over 2-acre piece of land, leaving his mother with only 18 Decimals housing the house she currently lives in.

He also sold off 0.066 Hectares to Kampala City Council Authority (KCCA) at UXG827,453,640 in spite of an existing caveat on the estate, which is currently being contested by Edith (The mother) at the High Court of Uganda via Land Division. Daniel has not spared other family properties either.

Jubilative moods

Properties including the 600-acreage land in Nanvubya near Masuuliita in Luwero, Kawoko, Kkonge, and Kungu-Buwaate, which he sold to different buyers, as well as his mother’s two rental properties on stretcher road in Ntinda. When we contacted Dan Jakana on his known mobile number over the development, he told us that he was busy driving and that he will not dwell in non-issues. “The person who selected that I become the heir wasn’t crazy. So what if the clan leaders have thought otherwise!” He shot back and subsequently hanged up on the call or cut the line.

The fresh story:

Nonagenarian Edith Nagujja Jakana, 92, through her Lawyers of M/S W. MU UMUZA & CO. ADVOCATES, in civil Suit No. 1090/19 of the High Court of Uganda at Kampala, Land Division, is seeking legal redress over 0.066 acres comprised in LRV 4552 FOLIO 13 BLOCK 203 PLOT 11780 Land at Kazo, Kyaddondo, that was allegedly sold to Kampala Capital City Authority (KCCA) by her son Daniel Jakana and his Jakana Foods ltd, in disregard of an existing caveat.

Between June 2021 and November 2021, KCCA paid Jakana Foods Ltd, a total sum of UGX827, 453, 640 (Uganda Shillings Eight Hundred Twenty-Seven Million, Four Hundred Fifty-Three Thousand, Six Hundred Forty) being compensation for acquiring 0.066 acres of the described land, for purposes of construction of a drainage channel.

A transaction that was illegal owing to the caveat thus culminating into Nagujja seeking legal redress to recover the total sum of UGX827, 453,640 and also, general and punitive damages from KCCA, Jakana Foods Ltd and the Commissioner in charge of land registration, who failed in their mandate of taking charge and control of the office of titles, general conveyance among other duties.

The said land is part of the estate of the late Daniel Nelson George Nkuse Jakana who died on 24th December in 1994. The late Daniel Nelson George Nkuse Jakana left a Will dated 31st January 1971 wherein, he appointed his wife Edith Jakana, and his son, Daniel Herbert Lule Jakana, as executors of the same. On 28thOctober 2004, Nagujja and Daniel Lule Jakana as executors filed petition for grant of probate as duly appointed joint executors for the estate of the late Daniel Nelson George Nkuse Jakana and on 7th February 2005, Lordship Moses Mukiibi, granted the executors letters of probate for the deceased’s estate.

The late Daniel Nelson George Nkuse Jakana in his Will bequeathed the suit property located in Kazo to his wife during her lifetime and thereafter to his son James Senjogera. However, since then, the family has been embroiled in several wrangles that include sale of property and the depleting of the Bank account no 0070032163 of Tropical Bank Uganda belonging to Edith Nagujja, his mother, of a colossus amount of money.

The two separate gates that lead one into this vicinity are actually the invisible demarcations of the breakage of the solidarity that this family once enjoyed. Here is the position where Nagujja, who one would believe, would be enjoying her last prime years of a gifted long life, is right now. However, this is more of a dungeon of worry and fear of the unknown that she is forced to live as she stares in the skies wondering if she will still wake up the following day and still, call it home.

Troubles of this family begun on 24th December 1994, thanks to the passing on, of the family patriarch Daniel Nelson Jakana. Having been married to Jakana Snr on 16th December 1950 and begot seven children out of the union, Nagujja did not envisage that later on in life, one of her own born and raised children would reign terror on her person. Dan, who was once one of the apples of Najjuma is now the heart ache and reason for the triggers of her hypertension episodes.

It would be foolhardy for one to believe that Jakana Foods LTD, owned by Dan and the Jakana Family estate are one entity. We have since established that the business that carries a family name ‘Jakana’ simply took temporary residence at the estate and thus the current melee over two acreages between Dan the son and Nagujja his mother.
