At 94 years old, instead of basking in the cherished memories of a long life, she is entangled in a fight for her property rights and dignity, with the date 25^th October 2023 symbolizing her hope for a rebirth through the court’s intervention. Edith Nagujja Jakana’s twilight years have been marred by a bitter reality that has shattered her perception of familial bonds.

Despite having lived through numerous challenges, it is the betrayal and greed of her own son, Daniel Jakana Jr., that has pushed her to the brink. The widow, who had once believed her children to be her greatest source of comfort, is now grappling with the betrayal of one of her own.

At the heart of the legal battle lies a piece of land, registered as LRV 4552 Folio 13 Block 203 Plot 11780 Land at Kazo Kyadondo, which holds significant sentimental value for Edith Nagujja Jakana. Having placed a caveat on the land to protect her interests, she alleges that her son’s company, Jakana Foods Ltd., colluded with the Kampala Capital City Authority (KCCA) and the Commissioner for Land Registration to have the caveat unlawfully set aside without her knowledge. In a recent twist in the case, Edith’s legal team has applied to the court for the discovery of crucial documents.

These documents include certified copies of bank statements and payment details related to the substantial sum of UGX827,453,640, which KCCA allegedly paid to Jakana Foods Ltd. for a portion of the land. Additionally, she has demanded that Jakana Foods Ltd. provide bank statements for a specific account within a specified period. The Commissioner for Land Registration has also been called upon to provide a copy of the white page detailing all entries and encumbrances registered on the disputed property, along with the costs of the application.

The legal saga, brought forth in Civil Suit No. 280 of 2022, centers on the assertion that the respondents operated in violation of Edith Nagujja Jakana’s caveat, engaging in fraudulent and illegal activities concerning the land she holds dear. While KCCA and Jakana Foods Ltd. acknowledge receiving the substantial payment from the government authority, they have not disclosed the dates of the transaction.

The heartbreaking origin of this dispute dates back to the passing of Edith Nagujja Jakana’s husband, Daniel Nelson Jakana, in 1994. The family’s troubles escalated after his demise, with her once-beloved son, Daniel Jakana Jr., transforming from a cherished member of the family into the cause of her distress. The fear of losing her home in her advanced years, coupled with the emotional turmoil stemming from her son’s actions, have taken a toll on Edith’s health.

As Edith Nagujja Jakana waits for the pivotal court date on 25^th October 2023, she finds solace in her faith and prayers. The courtroom has become a symbol of hope, a place where justice might grant her a chance at a new beginning and a semblance of the dignity she deserves after a lifetime of trials and tribulations. The story serves as a poignant reminder of the complexities of human relationships, the vulnerabilities of age, and the enduring quest for justice.

The widow wants the commissioner to be summoned to explain to court how he was able to issue a Title to KCCA, at the time when her caveat was still present on her mother Title. She rejects KCCA’s and Jakana’s assertions that she was served through her postal office box number, asking her to go to the commissioner of land registration’s office to show cause why the caveat she had placed on the land shouldn’t be removed.

She wonders how, if her caveat was removed from her mother Title, as it is claimed, it is still again present there. Following the fresh revelations by the widow, the deputy registrar of the High Court’s Land Division, Agnes Alumu, has set June 1^st this year for her lawyers to formally apply for the commissioner’s appearance. She wants the commissioner to produce the White page of the Title to show whether her caveat is still there.

And if it is no longer there, she wants the commissioner to explain under what circumstances it was removed and while it’s still present on her own copy. Nagujja, in civil Suit No. 1090/19 of the High Court of Uganda at Kampala, Land Division, is seeking legal redress over 0.066 acres comprised in LRV 4552 FOLIO 13 BLOCK 203 PLOT 11780 Land at Kazo, Kyaddondo, that was allegedly sold to Kampala Capital City Authority (KCCA) by her son Daniel Jakana and his company of Jakana Foods Ltd, in disregard of an existing caveat.

Nagujja holds an equitable interest claim that the current proprietor, Jakana Foods LTD owned by Daniel Jakana, having been registered thereon without her consent as a kibanja holder, was subject to Civil Suit No. 1099 of 2019 which seeks for cancellation of the impugned Certificate of Title which was duly registered.

In the face of the said Plaintiff’s caveat, KCCA transacted with Jakana Foods LTD, leading to the mutation of 0.066 acres off the described land for purposes of construction of a drainage channel yet the caveat was at the time still intact.
