One of these Indians is a former President of the Indian Community. The second one once served as a Minister in one of the monarchies in Uganda, while the third one has a huge presence in the manufacturing of essential household goods. Commenting about the verdict, the trio called it a vindication of their community in Uganda, since Sudhir’s arguably dubious dealings, had been for a long time negatively interpreted by majority of Ugandans, to appear as if all of them are crooks.

“That one was a very nice piece of verdict. The same is good news to many of the rest of us innocent Asians who have been scandalized for so long, by his unbecoming conduct. We are relieved and feel vindicated,” is how these Asians have welcomed the verdict delivered by Justice QC Telling. These men, who have struggled to make clean wealthy on top of abiding by the laws of the host country, warn that should Sudhir and his ilk do not stop engaging in questionable schemes against Ugandans, another `Amin` might take up power in future and end up ejecting all of them out of the country, regardless of their non-involvement into such.

“At that point in time, God forbid, every one of us including those who are innocent, will suffer merely because a few bad apples in the basket would have spoilt all of us `apples`”, one them asserts. These respectable members of the Indian Community in Uganda go ahead and point out some of the dubious dealings which have been engaged in by some of their members, such as claiming properties which the deceitful claimants involved have never, ever at all, owned before the expulsion of the Asian in 1972, land grabbing and encroaching  on wetlands.

“Let this judgement serve as a rude reminder to all our people to avoid engaging in schemes which are criminal in nature, and which negatively impact the Ugandan State,” another one counseled. The trio, in separate interviews, note that whoever Asian was around and witnessed the untold suffering which the members of the community went through following their expulsion by Amin, should think thrice before antagonizing the Ugandan State and her people. This is because such provocation doesn’t sit well with majority of Ugandans and their leaders.

“Let us therefore conduct ourselves lawfully and responsibly, with a high degree of dignity and respect in order to escape the curse of expulsion again,” these exemplary members of the Indian community, counseled. They wound up by advising their own to each and every one of them strictly avoid being attempted by the greed for money and material things, to stupidly rock the boat in which they happen to be sailing together.

The Genesis

Sudhir had sued Bank of Uganda (BoU) in London, questioning the closure of his Crane Bank (CB) and passing the same to Dfcu bank. He had asked for more than UGX800Bn, saying that the Central Bank’s sale of Crane Bank to Dfcu had been tainted by corruption.

Yet Sudhir himself had run down CB by extracting billions of cash from the financial institution. He had owned up to the sleaze and committed in writing, to refund the stolen funds. But he later turned around, as obviously expected of him, to disown the confession.

BoU had sued Sudhir to have him cough up the proceeds of the sleaze plus the billions which the Central Bank had spent to try to recapitalize the bank but which, was again looted and which two crimes, the businessman himself had owned up to, and he himself committed to atone for, only to thereafter, disown such confession, via alleged breach of confidentiality against BoU. He had requested the Central Bank to keep his confession a `top secret`. But trust the mighty Investigator. We burst the story!

All the concerned courts in Uganda had backed Sudhir to get away with the sleaze, arguing that it was illegal for BoU to sue the businessman through the defunct CB, to recover the funds he himself had looted and he himself had committed to pay back. But the London Court has since turned the tables on Sudhir and by extension, the Ugandan Judges. This stance, by refusing to kowtow to the businessman’s schemes of looting the country out of an extra UGX800Bn which, our judges had previously gifted him with another UGX200Bn for may be, properly looting Crane bank to its grave! The Court in London ruled that what Bank of Uganda did by closing Crane Bank and selling it to Dfcu was legit and so, as a foreign court, there was no way they could interfere into the affairs of a sovereign State agency.

While we are finally relieved following the arrest, interrogation and statement recording of the people who hacked into our website and social media accounts, we are equally sorry for the hackers and their accomplices since they were used by arguably a heartless man who is out there puffing away.

It is really sad knowing that the suspects are young men lured into crime by a person fit to be their dad. As Sudhir Ruparelia and his family mind their businesses, the young people he led into trouble like a sheep being led into the slaughter house, are suffering. Sudhir managed to prey on these youths merely because they are poor. Because they are poor, they accepted the meager dimes he had to throw their way!

As we wrote warning the country about Sudhir, the young people now in trouble, on the contrary chose to join the oppressor and harassed us the messengers. They knew what they were doing was wrong, but Sudhir nevertheless convinced them to do the wrong thing using money.

This is only in our case but, Sudhir has used quite a number of people whom he dumps after falling out with them. Then he, using these young men and the poor keyboard warriors to character assassinate his ex-pals. The list is long but we shall dwell on a notable few:

Prof. Mutebile

Before falling out with Prof Emmanuel Tumusiime Mutebile over the closure of Crane Bank, Sudhir had used the good professor to issue reports year after year reflecting a rosier picture of the bank even when it was running into limbo.

The good professor would later eat his words after the closure of Crane Bank by admitting how Sudhir was cooking up figures which he would pass over to him, hence causing him to tell lies about the stability of the bank.

UK magazine

As Mutebile goofed away, another respectable business magazine printed in the UK, the Business Week was also using fake reports to pile Crane bank with awards year in year out!

Parliament, Judiciary

This is exactly how parliament and the justices ended up hounding the whistleblowers in Prof Emmanuel Tumusiime Mutebile, Justine Bagyenda and Louis Kasekende for merely doing the right thing of closing the bank which Sudhir had robbed dry. Sudhir was not only awarded hefty damages by the justices, but the same are supposed to be met by the taxpayers of which the justices are one.

Sudhir used parliament to clear him of the mess he caused at Crane Bank. Sudhir being Sudhir, he managed to move parliament to investigate Bank of Uganda and clear him yet other banks had suffered the same fate before and their fate did not reach parliament save after Crane bank was closed.

Muweebwa

Sudhir hounded Sylvia Ntambi Muweebwa out of her job as the boss of the Equal Opportunity Commission. It came to this level simply because the poor lady raised a red flag when the tycoon attempted to use her to have the Commission rent into his Kingdom Kampala building.

Hell broke loose when Muweebwa refused Sudhir’s evil advances. The poor lady was not only arraigned in court on flimsy charges of asking for bribes from Sudhir and abused in newspapers, but was finally  hounded out of her job. Months after going through a fake trial, Muweebwa was finally released never to receive her job back and with her integrity in tatters.

Compare this with us who Sudhir has framed blackmailers and extortionists, never mind that he tried to use people to approach us with money in order to stop exposing him, to see how dangerous this man is.

Supreme Court Clerk Luwangula

In order to buy Afrique Suites Hotel, Sudhir used a ‘poor’ man known as Ronald Luwangula who he staged as the buyer after paying him USD700, 000. We exposed the scam complete with evidence, indicating how Luwangula is a mere court clerk incapable of raising USD3.2m which Sudhir paid for the hotel. For saying this truth, Sudhir used poor men to hack us.

AG Joseph Ekemu

While buying Speke Hotel, which was owned by Ferroz Kassam along with others, Sudhir used a whole Attorney General and a man older enough to be his dad, Joseph Ekemu. An astute lawyer, senior citizen, experienced legislator, Ekemu ended up lifting the caveat which Kassam had lodged on the Title of Speke Hotel, helping the rogue to own the same! As Ekemu suffered embarrassment of being hounded out of his office, Sudhir was on the other hand busy looking for other properties to ‘buy’.

Ali Reza Kalan

Sudhir used Ali Reza Kalan aka A.R Kalan to mess up Crane Bank. He then cooked up stories of how he had run away with UGX50Bn intended to justify the hemorrhage he had visited on the bank. He has since switched off the poor banker and caused his disappearance to stop investigators from using him to tell the true story of Crane Bank.  

Sudhir further used Kalan to switch the properties of Crane Bank into the names of Meera Investments, remembering it is Kalan who brought the proposal of changing the properties from leasehold into freehold before Sudhir bought them cheaply and even permanently took them over instead of being a leaser.

Kakwenzire, Abdu Matovu

He used proxies to grab the property at Plot 8 Nakasero complete with a Title made from Nasser road, but which the President gratefully removed from him. The people he used are Abdu Matovu, who has since disappeared fearing prosecution and Davis Kakwenzire, a land grabber the President once ordered to be arrested.

Gen. Jim Muhwezi

He tried but failed to use Maj. Gen Jim Muhwezi Katugugu to help him escape prosecution for smuggling dollars out of Uganda. Like we have reported already in these pages, Sudhir sent money to the private accounts of the wife of Muhwezi, Suzan Muhwezi then held in the defunct Nile Bank.

Asmok Patel

He used to own the famous Kikagati Enterprises on Luwum Street dealing in farm implements. Sudhir joined Asmok while starting Premier Cricket Club. He then grabbed the name of Premier to start Premier Lotteries, but kicked Patel out later on. Patel ended up with a lot of unpaid loans and in Luzira prison. He died a disgruntled and poor fella! Like we said, the list is long, but the above can suffice for the time being.

Country Uganda on Saturday October 9, 2021, celebrated once again the ritual of independence. Oddly, the day passed without euphoria to speak of, save for the leaders who dressed up in suits and neck ties, underwear and what have you.

They were all dressed outfits made in the Western capitals and spoke the language of the much-hated Mzungu colonizer, to sycophantically address fellow citizenry on the alleged milestones attained by the African continent following the chasing away of the overbearing Mzungu.

As our leaders literally spoke the language of the Mzungu to themselves and their cheerleaders at the so-called independence celebrations jokily churning out milestone after milestone, that the African continent has debatably gained since the Britons and the like exited, elsewhere, majority of Ugandans were in muddy roadside excuses of markets, in gardens and betting houses, gambling to make a living, if any, more than half a century after we purportedly hit Canaan.

As our leaders were jumping into Hollywood-like oil-guzzling monster vehicles to go and celebrate independence complete with miles of escort vehicles and fancy driven toilets with their mistresses dressed in designer outfits made in the land of the Mzungu, as if in utter contempt of the so-called Buy Uganda Build Uganda policy, our poor mothers were in banana plantations embarrassingly pushing babies whose future is as grim as hell.

Elsewhere, hundreds of our mothers were being carried on improvised ambulances in form of wheelbarrows and ‘’butandaalo’ as well as rickety boats over tens of miles, making to health centers lacking essentials to give birth to children whose pretexts of dads are too broke to render them any meaningful future.

Yet more of our poor mothers were slowly but surely dying in excuses of health facilities and at places of the so-called traditional birth attendants whose only claim to expertise are bogus concoctions which they apply on their clients. After dying as surely as day follows night, these poor women then join their counterparts numbering more than 500 who lose own lives every year while miserably giving birth to another life.

In contrast to the above, tens of mistresses, First daughters as well as First granddaughters of our nationalistic leaders,  on the other hand, were flying first class in expensive jets, going to the Mzungu upscale health facilities in the Western capitals to securely give birth to future leaders.

Honestly, and with all due respect, Africa cannot be said to be liberated at a time when our leaders are frequenting Western capitals to seek medication while leaving behind their own people to die in hospitals without essentials and where medics aren’t paid lunch allowances.

Its siasa kabisa, pun very much intended, for anyone to submit Africa is liberated at a time our leaders keep showing up in the Western capitals with begging bowls, shamelessly asking for alms half a century after we purportedly gained independence.

It’s nonsensical for us to celebrate independence, save for our leaders who are visibly liberated, not to mention selfish, at a time our children are walking miles barefooted and hungry in the name of seeking knowledge  imparted by equally hungry but also angry teachers, giving lessons under trees, exposing both learner and instructor to the harsh vagaries of nature.

It’s hypocrisy of the highest end for our leaders to say we are liberated at a time they are busy inhibiting us from enjoying our freedoms such as the right to bail. It’s imprudent honestly for anyone to claim Africans are liberated at a time their brethren holding power aren’t allowing them to partake of power.

It’s improper, for lack of a better word for anyone to assert we are liberated at a time our fellow African leaders are busy shooting us dead just because we have said enough is enough and expressed displeasure about what is not going well in society.

I pretty much feel it’s not good manners to assert Africa is liberated remembering that our fellow Africans have since joined the Mzungu to loot Africa blind and now that they are stacking their wealth in the Western capitals.

It would be absurd to hear anyone proclaiming Africa is liberated at a time our leaders are not courteous enough to leave power peacefully.  I submit it is not biblical for anyone to be heard alleging we are liberated at a time our leaders are busy desecrating our national Constitutions on the way to disgracefully convert African states into monarchies.

How can Africa be said to be independent at a time our leaders are busy handing everything to the Mzungu to use as he pleases and take all profits back home leaving us with crumbs to partake of our wealth?

How can Africa be labelled independent at a time our leaders are busy forfeiting our continent to the Mzungu in the name of securing loans, a big percentage of which end up looted by a cabal in governments? Isn’t it right to say the Mzungu is going to return one day and grab our continent  long after the people who took the loans and used the funds as they pleased have long gone?

It’s really contemptuous for someone to tell us at one fora that we are liberated and then goes away and pick loans without consulting us and which loans would be paid by our grandchildren long after the people who borrowed them and ourselves have long gone the way of all the flesh.

Someone tells us during independence celebrations how we are fully in charge of our economy after getting rid of the Mzungu. And then the same person before what he or she stated has fully sunk in, jumps on the next flight of a luxurious Gulf Stream made in the Western capitals, moreover, and the next you see and hear, is them begging the Mzungu to come and fix the same economy they asserted just days back, we are fully in charge of! If that’s not kandolindoli, honestly, help clarify what it is?

Stop mocking Uganda mbu yasajjakula (self-reliant) merely because a Mzungu got tired of physically ruling her and then handed the national flag to one guy hoisted it at Kololo. Truth be told, Uganda tenasajjakula, going by the fact that it can’t make something as simplistic as a safety pin fifty years later on.

I say, at the pain of being labeled unpatriotic and westernized, it’s scandalous for someone to be heard submitting Uganda yasajjakula at a time the jolly learned guys at Kiira Motors are simply picking bus parts from across the boarders before putting them back together and then our guys at the National Planning Authority go on to proclaim how we are firmly on the road to the first world.

Fair people, you don’t become the manufacturer of a vehicle just because you undid it in the first place and then put it back together. I maintain you don’t deserve accolade, even when you go ahead and cleverly put marks on the bus to indicate you manufactured it!

Some people after proudly proclaiming they are presiding over states which are independent, then you witness and hear them expressing joy because there are part of an association of former colonies whose leader, by the way,  is the former oppressor-in-chief, if not still is.

They don’t stop at that, they even pay pilgrimage now and then to go and pay homage to the former, if not current, oppressor-in-chief. People of good wisdom don’t engage in such mockery. This is why you have never seen nor heard America partaking of such theatre much as it was a former colony of Great Britain. Yours truly thinks if a man is still being cared for by his parents, he cannot claim to be independent of the same, even if he happens to be half a century old.

Little wonder many Ugandans no longer join their leaders to celebrate independence. They have learned with time to mind their businesses in order to obtain financial independence on the way to becoming fully independent, other than mocking themselves celebrating liberation which is academic or simply put, in name. Can the debate start?

Opinion: Courtesy demands that I congratulate city businessman and Federal Republic of Nepal Consul to Uganda, Dr. Sudhir Ruparelia. The tycoon last week pulled off yet another ‘victory’ against Bank of Uganda.

The Supreme Court justices unanimously blocked the already executed process of liquidating Crane Bank Limited (CBL) possibly because it’s dead and rotten. The justices further ruled that the regulator erred to place CBL under receivership against a court order stopping the process.

Following the verdict, I sought out the lately uncommon gentleman, Mr. Common Sense for his views. Fortunately, I got him in the mood of talking. He made quite interesting observations and powerful submissions using simple words and examples. The views are exclusively his and I am a mere messengers of them. Enjoy the voyage.

Mr. Common Sense starts by teaching how he is in very short supply lately, especially in the judicial corridors. He explains that just because he is common and priceless, just like oxygen, people tend to take him for granted and herein lies the big tragedy! He says because people ignore him, it has led to all manner of tribulations the world is facing today. I ask him to expound, but he advises me to be patient, that what he is about to tell me will take care of that.

He starts by telling me in simple terms what the pompous justices meant by the verdict they wrote. He avers that in closing Crane Bank, the Regulator acted just like a Doctor who rightly removes the life support machine from a patient in a comatose state. He goes deep to demonstrate how actually the midwife, in this case Sudhir, killed the baby called Crane Bank Limited (CBL).

You ought to note that he uses the word baby figuratively. He explains the midwife did so by cutting the umbilical cord from the baby. While it is common knowledge babies feed and receive oxygen and blood from the mother via the umbilical code, Common Sense labors again, to remind me of the fact.

Having laid that background for me, he proceeds to confirm to me how the midwife actually killed the baby. “It was simple, though cruel my boy. The midwife removed the umbilical code worth a total of UGX397Bn from the baby. After the fact, CBL lost the lifeline and like the hapless baby it indeed was, there was no way it was going to survive in the circumstances.”

He stresses that whether the Doctors, in this scenario BOU, kept CBL on oxygen in that comatose state or not, none of the two decisions had the slightest like hood of saving it since the midwife had killed it anyway. Away from that, Common Sense demonstrates the magnitude of the recklessness committed by the midwife. “CBL required only an umbilical code worth only UGX25Bn to survive but the midwife deprived it the same. He actually cut more codes worth UGX397Bn, a figure capable of keeping alive a dozen set of babies.”

Common Sense would then wonder why none of the people concerned is showing any interest in the heist the midwife committed! “It is interesting to see the midwife bump fisting and laughing violently while continuing to hold onto the loot  unhindered,” fumes Common Sense, now clearly agitated.

Imputing bad motive on part of the law enforcers, he jokes; “You live in an intriguing world. In my world, I reign absolutely. Bank robbers aren’t given any slightest chance to move freely as if everything they did is fine. I make life very painful for bank robbers. We don’t even celebrate them; lest we alert young people it is all fine,” his words drip with sarcasm.

Common Sense tells me heists of the magnitude committed against CBL, not only end up rocking the bank involved, but also the banking sector as a whole and counting. It has a multiplier effect. The banking sector loses since people lose the motivation to do business with them. The people keeping the cash in holes or tins also lose. They tend to spend it since it is available 24/7. This denies them opportunity to save the funds to engage in income generating activities.

With the people not banking, Common Sense lectures has it, the businesses lose liquidity since they too, ordinarily borrow from banks. The government loses account of contracted savings. The banking sector deprived of enough liquidity cannot obviously remit meaningful taxes to the government, nor can new investors be motivated to invest in a country where saving culture is low. I remind him about the court injunction which stopped the doctors from putting CBL off oxygen and burying the same!

He reminds me too, that the injunction is cynical since the midwife had killed the baby anyway. “Sensible doctors don’t keep going on and on pumping oxygen into corpses,” he maintains emphatically. He admits the midwife walked out of the Supreme Court with billions in costs. But he quickly reminds me the taxpayers are the ones going to pay the dimes. Other than that, Common Sense informs me, since the baby was buried by closing and placing it under receivership, the injunction followed the same to the grave.

What the midwife is left with is the blank Cheque handed to him by the justices, giving him the leeway to cite the doctors for contempt. But also, since the liquidation has been stopped, the midwife can for the time being keep the assets of CBL not yet auctioned for purposes of realizing funds to pay off creditors. He can use the blank Cheque to milk more from the taxpayers.

Common Sense however informs me all isn’t lost since doctors are still in court trying to recover the main umbilical code of UGX397Bn the midwife deprived of baby CBL. Given the fact that the midwife admitted depriving the baby of the same, and in black and white for that matter, Common Sense submit powerfully,  the doctors’ case could turn out to be the huge whale which will finally swallow the midwife.

But he further tells me to tell the taxpayers not to jubilate prematurely. He submits that they instead should go down on their knees in prayer beseeching the Almighty to prevail on the justices not to end up conjuring up procedural excuses to defeat the confession the midwife himself authored. Common Sense signals to me to remain seated for a couple of minutes. He tells me he can’t leave before delivering his own version of judgment in the matter.

Common Sense Verdict:

I will reproduce the verdict verbatim and it goes thus; “I find the midwife guilty of deliberately killing baby CBL for the reasons I have articulated above. I direct as I hereby do that the midwife surrenders the main umbilical code since in our culture, it is jealously guarded.

The midwife must also pay interest applicable, damages for failing in the duty of care, for betraying the baby, for stealing from the baby and for converting things meant for the baby. The midwife is further directed to pay damages for using proxies to steal from CBL, for using proxies to pass off as shareholders of CBL, for influencing CBL staff to engage in crime for his benefit and for denying his confession.

I acquit the doctors forthwith unless held on other charges. They commendably moved in quickly and decently buried CBL. The midwife had killed it yet he wanted to keep the dead body mockingly. For emphasis’ sake, if the doctors had not buried CBL, chances are high it was going to end up emitting a stench that could have surely contaminated the atmosphere in the national coffers.

The Doctor did the right thing in my view since the stench was going to adulterate the oxygen from which the justices too, draw a living. I SO ORDER. But before taking leave of this matter, I have a few words of counsel to volunteer to the Doctor. Never again splash money on comatose like you did in the case. Hesitating taking comatose to their final home is not only disrespectful of the dead but also unnecessarily bleeds the national coffers which is what actually happened.

This kind of indecision further gives the culprits, time to compromise witnesses and anyone else capable of spilling beans, investigators and some judicial officers. It allows culprits a lifeline to sponsor disappearances of key witnesses and accomplices, destroy evidence, break in government offices to steal documents containing fiction shareholders, alter ownership of properties owned by the deceased, rob billions of cash left behind by the deceased, stash away such robbed cash in quick developments and to write off debts due to the deceased taken by the culprits themselves… my host now taps on the table to signal yours truly ‘it’s time up.’ We rise up, exchange pleasantries and part ways.

This follows an inquest into the abuse of Covid 19 regulations in the district by the ‘visitors,’ which development the security gurus have also termed as a security threat! Other complaints are said to have been made by motel and lodge proprietors, who claim that the visitors had accumulated huge unpaid bills at their rendezvous, under the guise of being official guests of the Operation Wealth Creation, on pending appointment.

Under a telepathic quest for the much coveted Covid 19 relief, from the Operation Wealth Creation overseer, Gen. Salim Saleh, many had actually made Gulu their second home in an effort to find a way out of the poverty jam made worse by the lockdown which, has set their activities under the cliff, for one and half years now.

Rumor in Gulu town has it that several women, including under cover moonlighters, have been put out of job, after being impregnated by some of these visitors who, thereafter disappear into thin air. It will now require one to have prior clearance from the OWC and RDC, to access any happening or hotel facilities, for any person claiming to be a guest of Gen Saleh.

Musicians including Jose Chameleone, Weasel, Pallaso, Feffe Bussi, Cindy, Phina Mugerwa, Kabako, Ronald Mayinja, Catherine Kusasira, Ziza Bafana, as well as comedians and promoters, have been flocking Gulu City at will.

We have also established that most of the activities that have been associated with artistes under the OWC, are in the process of being moved to the Prime Minister Robinah Nabbanja’s office, which will in turn wind up the now infamous Gulu treks.

By God’s Grace, the burly businessman, also the Federal Democratic Republic of Nepal to Uganda today, Dr. Sudhir Ruparelia one time in the past gave out a really fat bribe but the carrot ended up boomeranging on him.

Under fire for charges related to money laundering, Sudhir offered the bribe to the current security minister, Maj. Gen. Jim Katugugu Muhwezi who at the time, was a Brigadier and head of the yesteryears no-nonsense Internal Security Organization (ISO).

The year was 1991, Muhwezi had arrested Sudhir for trying to smuggle the foreign currencies out of the country. The businessman was chilling in police cells awaiting arraignment after which he was actually remanded in Luzira prison for four months before court released him on bail.

Fearing for the worst, Sudhir decided to wire a bribe amounting to ten million shillings to the Brig. Jim Muhwezi’s wife Account at the then Nile Bank along Jinja Road. He wired the money in equal instalments of UGX5M. He sent the first instalment on November 1st 1991 and on November 2nd 1991.

The money was intended to be an inducement for Muhwezi and the Criminal Investigations Department (CID) personnel, to block investigations and proceedings of a case in which Ruparelia was accused of attempting to smuggle checks and drafts amounting to UGX194M through Entebbe International Airport.

Aged 35 at the time, Sudhir lost it when Muhwezi rejected the bribe and instead informed the police who charged the giver with corruption, thereby complicating matters for the struggling businessman who was facing charges of the smuggled foreign currencies already.

He was arraigned before then City Chief Magistrate Edward Bamwite. Upon the charges being read to him, Sudhir asked for bail through his lawyer, Henry Kayondo. But the prosecution opposed him, contending that since the suspect had audaciously tried to bribe the DG ISO, he had proven himself capable of interfering with investigations.

The prosecution further submitted how Sudhir on securing bail would be tempted to flee from trial, being a foreigner. Lastly, Sudhir had dodged a number of questions during interrogation by the police, prosecution continued, which meant he was hiding something. Court ultimately remanded Sudhir in order to go and make a ruling on the bail application.

The Sudhir Project

Sudhir Project has been lately running in these pages. This is after he branded the Investigator CEO, Stanley Ndawula, as a total ‘extortionist’ and ‘blackmailer’. He piled this heave on Ndawula after we published a story of how the honorary Doctor had reportedly bought Simbamannyo House from Equity Bank via ‘proven’ fraud.

The story titled ‘An Auction that never was (…) got Sudhir so incensed to the point of hiring hackers who, entered into Ndawula’s social media networks. His agents used the Accounts to post disgusting stuff including nude pics of a one 21yr old Aisha Mutesi, a girl Ndawula had never known before. On top of that, his media team released story after story against Ndawula.

Not done, the hackers went for all the Investigator Staff members’ accounts and started producing stuff suggesting that all is not well between Ndawula and his colleagues namely, Mr. Muwambi Stephen and Mr. Jacko David Waluluka. The same Accounts are still in the hands of Sudhir’s hackers and are still being used against Ndawula and the Investigator… (Story for another day).

“He started it all. My intention is to inform the public how Dr. Sudhir has no moral authority to label anyone an ‘extortionist and blackmailer,’ he himself qualifies for the same. By the time we are done with him, the public will be contented how the man has ably lived a different life far away from his real one,” Ndawula said last night.

Oh Ruparelia! But in his wisdom Justice Andrew Bashaija reversed the presidential directives and restored the asset to Sudhir.

The Judge contended that much as the first person to transfer the land into his names, Abdu Matovu forged the signature of the commissioner of Land Registry, at the time Counsel Peter Walubiri, the same cannot be used against Sudhir. This posture, even when Court proceedings had it that the title in question was a product of Nasser Road!

The Judge argued that because Sudhir reportedly didn’t know about the forgery at the time he bought the property, nor colluded with Matovu, he is treated as a bonafide purchaser for value without knowledge of the forgery which took place before he bought the land. This stance, even when Sudhir had failed to present the void Title, claiming it was misplaced by his lawyers! The Judge disregarded and even avoided a mention of Sadrudin’s original Title which had been presented before Court!

Sadrudin had invoked the office of the President after he had been shocked to learn his property, which he had actually sold off to a third party, had changed hands three times already. He had embarked on the process of transferring the land on Plot 8 Nakasero, into the names of the purchaser when he discovered the names of Meera Investments Limited (MIL) present and his, which were registered long ago in 1962, missing!

A real estate developer, Pine Investments Limited owned by the immediate outgoing Attorney General, William Byaruhanga and former break-dancer cum the biggest entertainment industry guru, Charlie Lubega, is the one which had legitimately bought the land from Sadrudin. Alarmed because he seem to have sold air at a cost of over USD1.5M which he was now supposed to refund, Sadrudin Gulamhussein involved police.

But Sudhir being the egoistic Sudhir he is, he called upon his big pals who told him to ignore Gulamhussein and continue in possession of the property. Defeated, Sadrudin sent in a passionate plea to the President. The head of State was alarmed by what he had been told and by what he later read himself.

The son of Kaguta’s anger boiled over. He swore Sudhir was only going to expropriate the property over his dead body. The President asked Amelia Kyambadde, his Principal Private Secretary then, to put him through to the then Inspector General of Police, Gen. Edward Kale Kayihura. Once Kayihura picked the call, Museveni demanded to know why he (Kayihura) was handling Sudhir with soft gloves.

He directed Kayihura to leave whatever he was doing, move with light speed and force Sudhir out of Sadrudin’s property. “You risk facing charges of contempt of my orders if at all you refuse to carry out my instructions,” the President reportedly addressed Kayihura. And as would be expected in circumstances as these, Kayihura followed the orders of his Commander-in-Chief to the letter.

The Police Chief sent in his boys who rounded up and handcuffed Sudhir’s private guards before evicting them. The President then instructed the Lands Office to transfer the property back into the names of Gulamhussein. The Commissioner of Lands at the time, Karibwende issued the due notice to Sudhir asking him to surrender whatever Title he had, for correction. A relentless fighter and lover of material things, Sudhir instructed his lawyers of Nangwala, Rezida and Company Advocates to fight back by telling Karibwende how forgery was beyond the realm of his office. Karibwende then wrote to Gulamhussein to communicate his inability to handle the matter.

He advised the aggrieved Asian to try the courts of law instead. Museveni learned of Karibwende’s insolence. But Karibwende was just six months away into retirement. He did what he could and handed the matter over to the new Commissioner, Sarah Basangwa Kulata to revisit the same. She rewrote to Sudhir asking him to quickly send in the title in his possession.

But Sudhir, fearing for the worst since his Title had been found to have been improvised from Nasser Road, the country’s forgery hub, didn’t budge. Kulata didn’t waste more time. She rectified the record that had been so tainted by restoring Sadrudin’s names on the white page Title. The fact that Sudhir had run to Court and obtained an order stopping the deletion of his name from the white page, didn’t help at all. The no-nonsense Kulata all the same deleted his name.

History

Gulamhussein obtained registration of the land in 1962. Just like it happened to other Asians who were living, working and trading in Uganda, he lost the property when the President of the day, Idi Amin Dada woke up from slumber and directed Asians to pack up and leave Uganda in three months. It so happened that in June 2016, a one Abdu Matovu managed to have the land holding the property registered in his names.

Matovu has since gone underground. His disappearance is of course understandable though suspicious in the circumstances of this saga. If he had remained in circulation, he would have been obviously quizzed about how and from who he bought the building and the source of the money he used to purchase the same. He disappeared because as it’s well-known by whoever bothers to, he was a proxy.

Above all, Matovu would be rotting in jail after it emerged that he actually forged the signature of the former Commissioner of Lands while he went about transferring the property into his names. Shortly after registering himself on the Title, Matovu conveniently ‘lost interest in the property’ and sold it out to a one Davis Kakwenzire. Kakwenzire purportedly paid USD550, 000 to ‘acquire’ the property. Never mind that his name doesn’t feature among Ugandans who are moneyed but land grabbers.

Well, to jog your mind back, Kakwenzire is the guy the President ordered to be arrested over land grabbing a few years back. The Head of State had paid a visit to Nateete in Lubaga division to listen to tales of land grabbing when, the locals mentioned Kakwenzire who, the President right away directed for his swift arrest. He was accordingly summarily handcuffed.

Meanwhile, upon registering himself on the Title, Kakwenzire had moved fast and used the same to obtain a loan from Crane Bank… You guessed right, Crane Bank belonged to Sudhir who the President ruled later, to have craftily obtained the land belonging to Sadrudin. A few days after obtaining the loan, Kakwenzire developed a feeling that he no longer wanted the high value land, which he had, by the way, ‘acquired’ barely three months back.

He ‘looked for brokers’ to help find him a buyer. He found one. His name is Godfrey Kirumira. The choice isn’t surprising to the initiated. Kirumira has been Sudhir’s ‘errand boy’ for a long time as far as ‘buying’ property is concerned. Meetings ensued. They were held at Sudhir’s Munnyonnyo Resort Hotel. City lawyer, Wycliffe Birungi proceeded to the Land Office on the alleged assignment of carrying out the search of the register.

Done with the assignment, Birungi turned to his paymaster to report how he had not found any kind of encumbrance. But more exactly, any names of Sadrudin Gulamhussein on the Title. This still baffles those in the know because to date, Kulata’s stance still stands and Glamhussein’s names still appear in the registry. But this is a story for another day. Nevertheless, Sudhir then reached for his purse and paid the buyer-out at a fee totaling to USD850, 000.

Back to Court records, after securing the judgment in his favor, Sudhir started on the journey to file for a Special Title from Lands, claiming his (the void one) had completely gone missing for good. In the meantime, Sadrudin is not taking it lying down. He had secured a court order for maintenance of the status quo until his appeal is out of the way. Watch this space.

Simbamannyo Escapades: Shock as Supreme Court Clerk writes history after paying a cool USD4M in record time to claim Eng. Nevertheless, the myth that the political and economic affairs of Uganda are micro-managed and run by the mafia, is steadily taking form. Lately, the stories of Simbamannyo proprietor, Engineer Peter Kamya losing his properties to his creditors have flooded the mainstream and social media platforms, but with little or no hint of how!

In this first edition, we bring you a Supreme Court Clerk, a one Ronald Luwangula who purportedly bought one of Simbamannyo Estates Limited (SEL) properties in Mutungo, at a staggering price of USD4m. The subordinate court official bought the hotel in a well coined auction, as The Investigator have authoritatively confirmed. Luwangula is the purported buyer of the city’s prized Afrique Suites in Mutungo.

The alluring 3-Star hotel is nestled away in Mutungo, Nakawa Division. It sits on 0.1100 hectares of land. The little-known judicial officer is said to have bought the hospitality facility at an auction called by the Equity Bank. The bank sold the recreation facility purporting the owner had failed to service a loan he took in 2017.

The financial institution had put up notices inviting the people interested in purchasing the hotel when Ronald Luwangula supposedly stepped up and paid the enormous buy-out fee in no time. The hitherto owner, Engineer Peter Kamya, a reclusive professional architect and city businessman whose signature dress is Kaunda suits, is now trotting in Court corridors trying to question the procedures taken.

This hotel sale off is a case of double trouble for the lanky businessman since he also lost his premium Simbamannyo complex to tycoon Sudhir Ruparelia. This too, is wrapped in the same file where, Kamya’s lawyers are grappling to save him the loss, citing gross inconsistences involved in the entire transaction (Details in the coming stories).

Back to the main story; Luwangula is said to have bought the hotel through a company known as Luwa-Luwa Investments Limited (LIL). While the company is said to be carrying out the business of online trading, its certificate of registration indicates that it is a general services company.

Registered in October 2016, LIL’ subscribers are recorded as Ronald Luwangula and Claire Luwangula. The other four were reportedly juveniles at the time of the registration. And they are Rodney Jjuuko Luwangula, Rodrick Jjuuko Luwangula, Ronell Luwangula and Clare Ndagire Luwangula. The Company’s registered physical address is are recorded as Kob House along Ben Kiwanuka Street, in the vicinity of Imperial Hotel, overlooking Watoto Church.

The Conundrum

Luwangula is believed to have bought the hotel in question on October 18th 2020. Curiously, the purchaser was not only able to transfer the property within a matter of less than two hours, but was also able to place a caveat on his new catch within almost the same time! Court records indicate how the ownership of the property was altered at 2.03pm and then a caveat was placed at 2.06pm. In other words, the two transactions happened in a space of three seconds!

Records harbor that the transfer was effected under instrument number KCCA-00074654 while the instrument for the caveat is number KCCA-00074657. The fact that the purchaser altered the ownership of the property and even caveated it in the manner he chose to, helps perhaps, to indicate he was fully aware of the controversy surrounding the whole deal by the time he chose to go into the transaction.

This website understands that the deal was concluded before the actual auction took place. The auction the bank alleges to have carried out was merely a formality ostensibly to hoodwink whoever they wanted to. In fact, we have good reason to suspect that the buyer of this hotel was a different person altogether. The one on paper, and the same we are laboring writing about, must merely be a proxy for someone weighty.

Documentary evidence further suggests that someone paid really good money beforehand to the lawyers of the Equity Bank, possibly as an inducement to help him land the property. We have established that the Bank lawyers exchanged notes with the buyer’s lawyers to ultimately buy the property or refund the staggering ‘kitu kidogo’ in dollars.

During the email exchanges, the ultimate buyer asked the Bank lawyers to get a guarantee from their client that he would be refunded the money he paid upfront, in the event the bank sold the same to a different person.

We understand that out of the money which, by all nature and structure replicates a bribe, the alleged buyer, Luwangula, on 1st October 2020, received USD700, 000, hence crediting claims of him possibly posing as a proxy. Why would one be bribed to buy something they truly want and able to have!

That Luwa-Luwa had less than a month before the transaction opened up a United States Dollar Account in the same bank that auctioned the property , is another story of its own. Going by the certified documents before us, our Investigators claim a right to believe that the account was opened by Luwangula for purposes of receiving his share out of the money the true buyer deposited in bribe.

Whereas we are not condoning Eng. Kamya for reportedly failing to please his creditors on the agreed repayment schedules, we are persuaded that negative efforts were too heavy for him, given the fact that everything was pre-arranged long before even the official sell-off was in the drive gear.

Court documents indicate how the no nonsense city lawyers of Muwema and Company Advocates have started on the tricky legal journey to reverse SEL properties’ sale. They aver that Equity Bank acted in violation of Kamya’s rights to redeem the mortgages issued under the impugned facility of 30th November 2017. She recognizes the fact that she is not the best out of the forty five million Ugandans among whom, are highly educated professors, but adds that God chooses the lowly to shame the proud.

“I am here to work. I have no time for Ssemuju’s idle talk. I have to take development to Kira municipality (Ssemuju’s constituency),” Nabbanja asserted.

Nabbanja was reacting to Ssemuju who questioned her capacity to serve as the country’s Prime Minister. Commenting on the appointment of Nabbanja to one of the country’s key position, Ssemuju dismissed the woman from Bunyoro as a low-caliber person devoid of the technical know-how to deserve such a calling.

But, reacting to Ssemuju’s assertions, Nabbanja boasted how she has been accomplishing big tasks only that she is not a show-off and a talking shop like Ssemuju. “I don’t like showing off what I have done. But I have accomplished a lot. I love to work without making noise,” Nabbanja states.

She challenges Ssemuju to show what he has done as the outgoing opposition’s chief whip. “How far has he moved the opposition? What tangible thing has he done for Kira municipality apart from engaging in propaganda and gossiping?” Nabbanja said before excusing herself from discussing idlers and propagandists.

This Website can authoritatively reveal that the land in question actually belonged to an association of Veterans by the time the Gen. Tumukunde sold it as his. The veterans have since sold off the same to former State Minister for Economic Monitoring, Henry Banyenzaki.

“That is my land. I have a title to it. Whoever says the land is his is a fraud star,” is how a surprised Banyenzaki offered when we sought his comment last night. The land measures 26 acres. Its particulars are Plot 5-11 Peninsula Crescent Lane and Plot 1-3 at the same locality.

While selling the land, Gen. Tumukunde is alleged to have told the buyer that the veterans were merely keeping guard of the land for him and that he was now desirous of disposing it off to do other things. But the veterans led by retired Sergeant Badru Matovu have since sold their interest in the property to Banyenzaki.

Senior citizen Hajj Muhammad Majid Bagalaaliwo is the man Tumukunde supposedly took for a ride. A seasoned businessman with shares in Coca Cola, the now frail Hajj aged 80 years plus, has lived with the heartbreak of losing his money for 13 years now.

We spoke to him and he was fraught. He told us thus; “I want the President (Read Court of Last Resort) to help me recover my money from his military officer.  I am an old man. How can a young man I trusted so much end up shortchanging me!” he said before angrily hanging up on us! More efforts to dig deep with him were futile as he jammed to pick our repeated calls.

The Genesis

As fate would have it, it all started with Gen. Tumukunde initiating the deal through a Real Estate broker known as Maurice Nuwagaba. Tumukunde is Bagalaaliwo’s neighbor in Kololo. So the Presidential aspirant must have known the old man’s appetite for prime land already. This could perhaps, illuminate why the former Spy Chief targeted his neighbor above all other people for a quick financial kill.

“The broker approached the old man and told him how Tumukunde was selling a prime piece of land on the shores of Lake Victoria,” insider sources reveal. Not one to pass on a good deal, the Hajji quickly moved to Luzira-Port bell where the land is located.

He wanted to have a closer look and first hand brief of the land, of course. He was elated by the scenery he saw. More so, the land he was supposed to buy is in the vicinity of an island. The island is home as well as a breeding ground for the white birds (enyange).

The old business soul had longed for years to construct an eco-tourism site. He was accordingly overjoyed seeing that his long-held dream was now starting to unfold before his own eyes. He returned home to pick his dear Hajjat for to, herself check out their long awaited dreamland.

Hajji ignores Hajjati’s advice, cash delivered to seller in boxes

Much as the man of the house was overjoyed by Tumukunde’s supposed land, the wife was on the other hand not amused. “Gen. Tumukunde wasn’t in possession of the title of the land he was calling his. What was he selling then? This made Hajjati skeptical of the whole transaction,” insiders elucidate.

But Tumukunde knew his say around this hurdle. “He convinced the buyer to go ahead and pay because the title was being processed. He said it would only be a matter of time before he got hold of his title,” Mzee Bagalaaliwo fell for the trick. After all, the businessman was not in the mood of delaying the deal he thought was too good to pass on.

How he now wishes he listened to his dear wife. Instead he quickly sent for money to be picked from one of his companies known as Transnak Financial Services. A deposit of USD400, 000 out of the purchase price of UGX1.8Bn was quickly arranged by Mzee’s financial handlers. The huge cash was delivered in two boxes at Tumukunde’s Kololo residence lying on the lower side of Kololo Airstrip.

The transaction was reduced into an agreement. We have the agreement dated September 3rd 2007. Tumukunde is indicated as the vendor as well as one of the shareholders of a company known as Fish Eagle Limited. The other co-director is named as Paul Kuteesa and the other as Oscar Kambona. It is worth pointing out at this juncture that by the time Tumukunde allegedly hatched this transaction, he had just been released from the military prison over statements he had made before on an FM radio station that his masters in the military felt were bellicose.

Buyer heads to Police, Court

To cut the long story short, Bagalaaliwo is now pursuing both legal and criminal charges against the Presidential aspirant. In the Civil matter before Justice Susan Abinyo of the Commercial Division of the High Court, the businessman wants the army General to either hand him the land he purportedly sold him, or refund the cash, of course with interest.

He further seeks for monetary damages for the breach of contract on part of the seller, as well as the interest agreed at the time of sale till Tumukunde finally clears. In the criminal charges overseen by senior detective Elly Womanya, Tumukunde is facing charges of obtaining money by false pretenses, implying he took the money with full knowledge that he had no land to sell.

Seller disowns agreement

On his part, Tumukunde is said to deny any wrongdoing. He even, reportedly disown the sale agreement much as it bears what is believed to be his name as well as signature. Watch this space…
