The MD of Ruparelia Group, Rajiv Ruparelia has sent a tough notice to DFCU warning the bank of a brewing legal battle should the financial institution not retract statements that he has been sponsoring negative stories about them.
Rajiv’s lawyers of Walusimbi and company advocates have already dispatched the notice giving DFCU up to close of business this week to have owned up or face dire legal consequences.
DFCU’s lawyers of Kalenge, Bwanika, Ssawa and company advocates received the notice on behalf of their clients. “We are consulting our clients to see how to respond to the notice from Rajiv,” one of the lawyers familiar with this matter intimated to this website.
It is DFCU’s lawyers who kicked off the storm by issuing a legal notice on October 5 accusing Rajiv of supposedly sponsoring several online publications to publish negative stories about the bank.
But in his notice, Rajiv expresses outrage over the bank’s action of giving away his confidential details to the public via the legal notice issued by its attorneys. The son of property mogul, Dr. Sudhir Ruparelia is a customer of DFCU following the financial institution’s takeover of Crane Bank that has since proved to have been messy at least going by an inquiry commissioned by the Auditor General.
The Auditor General faults Bank of Uganda among other failings, of selling Crane before having audited its assets comprehensively. BOU is said to have relied on an audit account by DFCU to determine the price the same bank (DFCU) bought Crane bank! Crane bank owners have since accused BOU of selling the financial institution at a song together with all its assets that were worth more than UShs1trillion.
“Our client’s attention has been drawn to various social media publication through your agents M/S Kalenge, Bwanika, Ssawa & Co. Advocates clearly expressing themselves to be acting on your instructions wherein they, to his regret and enormous inconvenience published and widely circulated among others his phone number – a detail otherwise given to you in confidence tied to his account held with yourselves by virtue of having succeeded the same from the Crane Bank Limited (in receivership).
Consequently, Rajiv demands for an immediate formal apology which he says should be relayed on all platforms where DFCU’s legal notice was carried. He also seeks for atonement in terms of unspecified cash.
