With all the signatories to documents that fraudulently offered the land to the four impostors confessing that their signatures were forged, plus the fact that two of the fraudsters were found chargeable by courts of law, and got imprisoned for two months over the same, and that the initial credentials granting the land were issued by Kajjansi Town Council in 2014, long before its formation in 2018 and formulation in 2021, one would think that this case is obviously home and dry. And, Oh yes, with the workers` money safe and secure.
But this isn’t the case yet! We impeccably gather how some of the Board Members at NSSF are in deep romance with the fraudsters, trying to arm twist NSSF into buying its own land at a staggering UGX200Bn! All in the name of compensation. We have also, authoritatively learnt how the Directorate of Public Prosecution (DPP) have not only crossed to the charlatans’ side, but have since amended and reduced their charges, before replacing them with the case whistleblowers, the same Lands officials at Wakiso whose signatures, they confessed in black and white, were forged. And hey! Even Honorable Justice Musa Ssekaana of the Civil Division of the High Court did, rule in favor of the proven fraudsters. But why?
For starters, the land under review is comprised in Block 269, Plots 3234, 3235, 3236, 3237 and 3240 of Kyadondo at Lubowa. Before being sliced into these plots by the fraudsters, it was initially in one piece, peacefully lying in one block and measuring forty-five hectares. The prime suspects and strongly alleged fraudsters are Muhammed Kityo Lubowa, Nakanwagi Dauphine, Namanya Betty and Bogere Moses. The quadruple`s relationship is a matter subjected to further investigations by this website at a latter stage. Like the preamble states, one would have considered this case a closed matter. But what follows is the reason why this is a dead thought.
Enter Speaker Among Magogo Anita Annet (AMAA)
Yes, on August 21st 2022, while hosting HRH the Kyabazinga at their home, she mentioned the desire to have her newly acquired husband, Moses Magogo`s name added to her three. For this matter, we wish to kowtow to her wish but with a short form of AMAA. We can authoritatively reveal that it was the entry of AMAA that offered a kiss of life to this rather dead and nearly buried case. She did her maiden entrance vide a letter to her Master, President Museveni on July 19th 2022. For purposes of a clear flow of this piece, this particular letter will serve as our entrance into details of how the nearly resolved matter got back to life.
“I received a petition in respect of the above subject wherein the petitioners claim to be owners of the captioned land yet the National Social Security Fund also claims the same. I noticed that various Government MDAs have investigated the dispute and seem to find fault with the certificates of Title carried by NSSF,” she wrote, adding; “A perusal of the petition reveals that the Ministry of Lands, Housing and Urban Development, through the Commissioner Lands Registration and the Commissioner Surveys and Mapping, and the State House Anti-Corruption have previously dealt with this matter.”
AMAA proceeds to tell the president what she knows to be sweet music to her ears thus; “The petitioners claim to have sourced investment partners who were willing to commit United States Dollars Four Hundred and Fifty Million towards redevelopment of the property in issue but lost interest due to the persistent wrangles between the NSSF and the petitioners.” As if the last statement isn’t enough for speculators to view as a blackmail, she concluded by requesting the Fountain of Honour to take up the matter since she couldn’t risk its `sensitivity` with parliamentary intervention!
For starters, the Wakiso District Land Officials, who also happen to be the whistle-blowers and whose signatures were forged, include; Katabalwa Herbert Miiro, the former Wakiso District Land Board Chairman, his Ag. Secretary Dr. Batume Kizito Joseph and Gilbert Kasozi, the Wakiso District Senior Lands Management Officer to date. Other Ministry of Lands Officials whom AMAA mentions as having dealt with this case include Janat Nabuuma, Senior Registrar of Titles, Karuhanga John, Ag. Commissioner for Land Registration and Gilbert Kasozi, the actual official who verified and determined the fraud existence.
Surprisingly, in her letter to the President, AMAA suggests that the government officials who dealt with the matter, including those of State House Anti-Corruption Unit, faulted NSSF. “I noticed that various Government MDAs have investigated the dispute and seem to find fault with the certificates of Title carried by NSSF,” she wrote. But at the same time, in the same letter, she also admits that whatever information she was passing on to the President, was sourced from her `Petitioners` submission in entirety. “A perusal of the petition reveals that the Ministry of Lands, Housing and Urban Development, through the Commissioner Lands Registration and the Commissioner Surveys and Mapping, and the State House Anti-Corruption have previously dealt with this matter.” The President is yet to respond to her letter.
The Story in Detail
However, the above gives credence to our reservations that AMAA never actually saw, perused, internalized and or understood the mentioned Government officials` take and final resolutions in the matter. Documents before us indicate each and every official`s detailed findings and resolves. In the matter of fact, they all faulted and pinned the quadruple fraudsters’ fraudulent acquisition of the NSSF land. Janat Nabuuma, the Senior Registrar of Titles, in an Internal Memo on December 11th 2019 wrote to Gilbert Kasozi, the Senior Land Management Officer at Wakiso District, instructing him to “kindly verify the authenticity of the minute under which the above property was purportedly granted in favor of Lubowa Muhammad Kityo, Bogere, Namanya Betty and Nakanwagi Daphine before we take further action.” The letter was received by Wakiso on the same day.
One week after, on December 18th 2019, Kasozi reverted with his findings and advisory submissions to Nabuuma. He said that according to available records, the said minute was fictitious and non-existent. He also revealed that his signature on both the purported offer and the forwarding letter were a total forgery. “So were the signatures of the Chairperson and the Secretary District Land Board; not to mention the illegalities therein.” It is also in Kasozi`s letter that a revelation was made how, the quadruple fraudsters` application was processed by Kajjansi Town Council Area Land Committee in November 2014 when the same was not yet in formation. “I have equally consulted the persons who purportedly signed as Area Committee members and the trio has denied ever authoring and documentation in respect of the above land. I accordingly advise that you take the necessary remedial action to purge the register of such high-handed fraud.”
Following these and other investigations within the Lands Ministry, John Karuhanga, for Commissioner Land Registration, cancelled the Titles on January 31st 2020. “Now therefore, by powers conferred upon me under S.91 of the Land Act, I hereby order that the following certificates of titles registered in the names of Bogere Moses, Lubowa Muhammad Kityo, Nakanwagi Daphine and Namanya Betty be cancelled and expunged from the Register Book forthwith for having been issued in error.” On the other hand, the Anti-Corruption investigations also, successfully implicated the quadruple fraudsters and two of them were remanded by Makindye Magistrates` Court for two months. However, trust the Ugandan Mafia. For, upon their release and the entry of big Government shots into the matter, the suspects went to High Court in Kampala where, Justice Musa Ssekaana, on December 18th 2020 ruled that the Commissioner of Lands had no powers to cancel the Titles based on the forgeries cited. Nevertheless, upon the DPP amending the quadruple fraudsters` chargesheet, adding the Land Officials and the supposed whistle-blowers, the latter have elected not to take the pill lying down. Gilbert Kasozi has, on their behalf penned a detailed petition to the Inspector General of Government (IGG) where, they also, strongly insinuate the Speaker`s engrossment as the blockage energies.
