KAMPALA, Uganda: This investigative website has been doing its best to report about the apparent deceit surrounding businessman Sudhir Ruparelia’s acquisition of the Ssimbamannyo building, plus the Afrique Suites in Mutungo, Nakawa division.
We hold the unshakable positive view in rhyme with Ssimbamannyo owners` serious allegation that Sudhir and the Equity Bank could have connived to deposes Architecture Peter Kamya of his properties. Yes, Kamya had taken loans from Equity and also, reportedly failed to discharge them on time.
But the process leading to Sudhir’s acquisition of his properties was itself shrouded in controversy and possibly illegalities. Equity had advertised to sell Kamya’s collaterals in a period of two weeks, but would end, matter of fact, carrying the auctioning prior to such clearly stated deadline. Other than sticking to the terms of the public auction, the financial institution instead resorted to vending out the collaterals to Sudhir, via its law firm of Katende, Ssempebwa and Company advocates.
This position, without extending an opportunity to the rest of the prospective buyers to join the auction and possibly benefit from the same via a transparently and a legally acceptable process. That one can be easily borne out by the secret email correspondences which the bank shared with Sudhir ahead of purchasing the properties.
This website has exclusively and meticulously busted such dubious transactions between Equity and Sudhir, well ahead of Justice Mubiru’s order which was directing Equity to produce the email correspondences to look at in order to establish what had exactly gone on behind the high walls of the bank. The lawyers of Katende, Ssempebwa and Company advocates and the firm of Sudhir’s lawyers referred to as Walusimbi and Company advocates before the final conclusion of impugned auction.
Both the Bank and Sudhir would revealingly skip Justice Mubiru’s clear order and indeed, went behind his back to lobby the Ugandan Court’s Chief Supervisor, Justice Rubby Aweri Opio, to stop Mubiru’s justifiable order for them to produce the email correspondences. Before the devious moves geared at aborting Mubiru’s order could be embarked on by Sudhir and Equity, we are now here to divulge, how a very senior lawyer in town paid a very secretive visit to Justice Stephen Mubiru’s chambers.
This private visit was meant to try to lobby the Judge into changing his mind, in regard to looking at the impugned emails that had been exchanged between Equity and Sudhir before the two parties, ahead of sealing the equally impugned transactions. The senior lawyer battled vigorously to charm the uncompromisable Justice Mubiru, to the extent of reminding him how he had taught him law, both at Makerere and later at Law Development Center. All this was in order to change his mind in favor of Sudhir and Equity.
But the tough and incorruptible head of the commercial section of the high court, our close sources reveal, instead counseled the dubious visitor to let justice take its course. Tried as he could to explain to his teacher the benefit of letting the wheels of justice to take their course, the senior lawyer insisted on his student going ahead to cause a miscarriage of justice in favor of his friends Sudhir, and Equity Bank. Pissed by the teacher’s unbecoming conduct, Justice Mubiru finally invoked his judicial orders to direct him to disappear as fast as he had come, or else, be cited for subverting justice. The senior lawyer went away cursing the uncompromising former student in Mubiru, and vowing to defeat him via other extrajudicial means.
Mubiru’s order for Equity to produce the impugned email correspondences between itself and Sudhir before the eventual auction of Ssimbamannyo and Afrique Suites has since been overturned by a superior Justice of the Court of Appeal.
